Thank you for contacting me yesterday to discuss your partner’s immigration case. This letter contains the advice for you. I will send you a further letter providing our terms of business.

Our Advice

Now that you have a pre-settled status in the UK, your partner, Hugo can apply for a family visa. If you are living in the UK on a skilled worker visa, Hugo can apply as a dependant of a Tier 2 (General) visa holder.

There are certain requirements needed while making the application. Firstly, You must show that you have enough money to support Hugo. You must earn a certain amount or have sufficient savings to bring Hugo to the UK to live. You need to show your last 6 months income (before tax) before the date of the application. You need a minimum income of £18,600 per year before tax. As you are earning £32,400 per month, you meet the financial requirements.

Secondly, you need to prove that your relationship with Hugo is genuine. You need to provide evidence/documents showing that you and Hugo have spent time together and are in frequent contact. You can produce your Whatsapp communication and Facetime details to support your application. You can produce the proof of your wedding and witnesses of your friends who attended your wedding.

Before making the application, Hugo may need to take an English language test and a medical test to show that he does not have Tuberculosis (TB). Other than this information, the application will need personal information of you and Hugo. Hugo’s details include: name; date of birth; current passport or other valid travel ID; copies of the photo page and any visa or entry stamps in previous passports; a copy of biometric residence permit, if any; any previous immigration applications; details of criminal convictions; national insurance number, if any; parents’ date of birth and nationality; a certified translation of any document that is not in English or Welsh; a blank page in the passport on which to put the visa; an email address to make an online application.

Your details will include your name; date of birth; nationality; passport; and right to be in the UK (you can provide proof of your pre-settled status).

If the application is from outside the UK, Hugo must:

apply online using Appendix FM Partner

make arrangements to provide your biometrics (fingerprints and facial photograph) by visiting one of the with commercial partner’s centres

complete the application form

pay the visa fee online

pay the health surcharge

provide your biometrics (fingerprints and facial photograph)

provide your tuberculosis test results if you are resident in a country where you must take the test

provide your passport and other supporting evidence

You have to provide an email address to complete the form. The form will have some more questions that I may need to ask while completing the form. I will pay the necessary payments online and complete the application. I will ask you to check the details on the form before I submit it to the Home Office. Once we submit the form, I will meet you to take the next steps.

Hugo’s visa will last for 33 months if the application is from outside the UK and 30 months if he is applying from the UK. Before the expiry of the visa, Hugo can renew it for another 2 years and 6 months. Once renewed, Hugo can apply to settle in the UK after a total of 5 years.

Louis is a Tier 2 (General) visa holder. The application is one of the All Points Based System (“PBS”) applications. It attracts the right of Administrative Review. Hugo can file an appeal to the immigration tribunal. As the application is from outside the UK, the time period is 28 days from the date of refusal.
